Interpretation and Definitions

Interpretation

A defined term in these Terms starts with a capital letter. What it means is listed below, and the plural carries the same meaning as the singular.

Acknowledgment

These Terms and Conditions govern the use of this Service and are the agreement between You and the Company. Every user’s rights and obligations regarding the Service are laid out in them.

To access or use the Service, You must accept and comply with these Terms and Conditions. All visitors, users and anyone else who accesses or uses the Service are covered.

Anyone who accesses or uses the Service agrees to be bound by these Terms and Conditions. If You do not accept any part of them, You may not access the Service.

You represent that You are over 18, because the Company does not permit anyone under 18 to use the Service.

The Company’s Privacy Policy matters here too: You must accept it and comply with it to access and use the Service. Its subject is Your personal information: how it is collected, used and disclosed when You use the Application or the Website, which privacy rights You hold and how the law protects You. Read it carefully before You start using Our Service.

Links to Other Websites

Third-party web sites or services that the Company neither owns nor controls may be linked from Our Service.

The Company does not control third party web sites or services and takes no responsibility for what they contain or how they handle privacy. Neither does the Company accept liability, direct or indirect, for any damage or loss caused or alleged to be caused by, or in connection with, the use of or reliance on any such content, goods or services available on or through those web sites or services, and You acknowledge and agree to that.

Before You use any third-party web site or service, We strongly advise You to go through its terms and conditions and privacy policy.

Termination

We may suspend or terminate Your access at once, with no prior notice or liability, for any reason at all, including a breach of these Terms and Conditions by You.

Termination ends Your right to use the Service on the spot.

Limitation of Liability

Your exclusive remedy for all of the above, and the entire liability of the Company and its suppliers under any provision of these Terms, comes to no more than the amount You actually paid through the Service, or 100 USD if You bought nothing through it. Any damages You may incur do not change this.

Where applicable law permits, the Company and its suppliers accept no liability for special, incidental, indirect or consequential damages. That means loss of privacy, personal injury, business interruption, lost data or other information and lost profits. It does not matter whether they arise from any provision of these Terms, from third-party software and/or hardware used with the Service, or from the use or inability to use the Service itself. They are excluded even if the Company or any supplier was told such damages might occur and even if the remedy fails of its essential purpose.

Some states do not allow implied warranties to be excluded, or liability for incidental or consequential damages to be limited, so some of the limits above may not apply to You. In those states, a party is liable only to the greatest extent the law permits.

“AS IS” and “AS AVAILABLE” Disclaimer

Warranties of any kind are disclaimed. Everything about the Service is supplied “AS IS” and “AS AVAILABLE”, with its defects and faults. The Company, for itself and on behalf of its Affiliates, licensors and service providers, expressly disclaims all warranties on the Service, whether express, implied, statutory or otherwise, as far as applicable law allows. Implied warranties of title and non-infringement, fitness for a particular purpose and merchantability are disclaimed, as is anything that might arise from usage or trade practice, course of performance or course of dealing. The Company offers no assurance that the Service will run without interruption, be error free, or meet any performance or reliability standards. It does not promise that the Service will meet Your requirements or achieve any intended results. Compatibility with other software, applications, systems or services is not promised either. Nor is there any promise that errors or defects can or will be corrected.

No representation or warranty of any kind, express or implied, comes from the Company or its provider on these points: (i) the operation or availability of the Service, or the information, content, materials or products on it; (ii) any promise of uninterrupted or error-free service; (iii) how accurate, reliable or current any information or content provided through the Service is; or (iv) whether the Service, its servers, the content, or e-mails sent from or for the Company contain viruses, scripts, trojan horses, worms, malware, timebombs or other harmful components.

Some jurisdictions do not allow certain warranty exclusions or limits on a consumer’s statutory rights, so some or all of the exclusions and limits above may not apply to You. In that case, the exclusions and limits in this section apply to the greatest extent enforceable under applicable law.

Governing Law

When it comes to Your use of the Service and to these Terms, the governing law is the Country’s, with its conflicts of law rules left out. Other local, state, national or international laws can also come into play when You use the Application.

Disputes Resolution

Before taking any concern or dispute about the Service further, You agree to raise it with the Company and try for an informal resolution.

For European Union (EU) Users

A consumer resident in the European Union keeps the protection of any mandatory provisions in the law of the country of residence.

United States Legal Compliance

Do not use the Service if You appear on any United States government list of prohibited or restricted parties, or if You are located in a country under a United States government embargo or designated by that government as a “terrorist supporting” country. By using it You represent and warrant that neither applies.

Severability and Waiver

Severability

Should any provision of these Terms prove unenforceable or invalid, We will change and interpret it to reach its aim as far as applicable law allows; all remaining provisions stay fully in force.

Waiver

A party that does not exercise a right, or does not require an obligation under these Terms to be performed, does not lose the ability to do so afterwards, unless provided otherwise here. A waiver of one breach is not a waiver of a later breach.

Translation Interpretation

If We have made these Terms and Conditions available in a translation on our Service, the original English text prevails in a dispute, and You agree to that.

Changes to These Terms and Conditions

These Terms may be updated or replaced by Us at any time, at Our sole discretion. We will make reasonable efforts to give at least 30 days’ notice before a material revision takes effect, and what is material is also for Us to decide.

To decline the new terms, whether wholly or partly, You must stop using the website and the Service. Staying on after the revisions take effect means You are bound by the revised terms.
